Justice Prevails: Acquittal in a False Case and Accountability Ordered

We are proud to share a significant recent success by Mr. Muhammad Arif Khan, Senior Partner at Legum Law Firm, who represented an accused in a trumped-up criminal case before the Court of the learned Additional Sessions Judge-V, Karachi Central.

After a detailed hearing, the Court not only allowed the application under Section 265-K Cr.P.C. and acquitted the accused represented by the firm, but also—on its own motion—acquitted the remaining co-accused on the same footing.

In a landmark and commendable move, the Court imposed a collective fine of PKR 500,000 upon the Investigating Officer and his supervisory officers (SIO, SHO, DSP, and SP) for conducting a mala fide, baseless, and reckless investigation that violated the fundamental right to liberty.

The judgment powerfully reaffirms that:

“When liberty is curtailed unlawfully, it is not merely a legal wrong but a moral tragedy… The judiciary must stand without fear or favour to protect the weak against the mighty.”

This order stands as a reminder that justice must prevail over convenience, and that the law continues to serve as a shield for the innocent and a check on abuse of authority.
