History of Emergency Rule in Pakistan

Pakistan’s experience of “emergency rule” covers three legally different things that should not be conflated: extra-constitutional martial law, constitutional proclamations of emergency, and Governor’s Rule in a province.

Military takeovers and extra-constitutional emergency: in 1953, limited martial law was imposed in Lahore during the anti-Ahmadiyya disturbances. In October 1958 Iskander Mirza abrogated the 1956 Constitution and imposed martial law, after which Ayub Khan assumed power. In March 1969 Yahya Khan abrogated the 1962 Constitution and imposed martial law. In July 1977 General Zia-ul-Haq took power and held the 1973 Constitution in abeyance, and in October 1999 General Pervez Musharraf did the same. On 3 November 2007 Musharraf, as Chief of Army Staff, proclaimed an emergency and issued a Provisional Constitutional Order; the Supreme Court held these unconstitutional in Sindh High Court Bar Association v. Federation of Pakistan, PLD 2009 SC 879.

Constitutional emergencies: proclamations of emergency were issued during the wars of 1965 and 1971. A further proclamation was issued on 28 May 1998, after the nuclear tests, under Article 232 of the 1973 Constitution, together with an order suspending the enforcement of specified Fundamental Rights. The Supreme Court examined the 1998 proclamation in Farooq Ahmed Khan Leghari v. Federation of Pakistan, PLD 1999 SC 57.

Governor’s Rule: direct federal rule through a province’s Governor has been imposed under the 1973 Constitution both under Article 234 and, while an emergency was in force, under Article 232. Examples include the then North-West Frontier Province (1975 and 1994), Sindh (1998), Punjab (2009, after the Supreme Court disqualified the Chief Minister) and Balochistan (2013, after the Quetta bombings). Earlier instances arose in Punjab (1949) and Sindh (1951) under the Government of India Act, 1935, as adapted, and in Balochistan (1973) under the Interim Constitution. On 11 October 2026 an emergency under Article 232 and Governor’s Rule under Article 234 were proclaimed in Khyber Pakhtunkhwa.
